This page is not the agreement. If you engage us, you get a separate written one, and that is the document that counts.

Who you are dealing with
Briar & Root Nannies is the assumed name of Briar & Root LLC, an Indiana limited liability company based in Warsaw, Indiana. Using this website means you accept the terms on this page. If you do not, please do not use the site.
This site is information, not an offer
Everything here is published to help you decide whether to have a conversation with us. Nothing on this website creates a contract, reserves a place in a search, or obliges either of us to anything.
A search begins when you and we sign a written engagement agreement and the application fee is paid. That agreement sets out the terms of the work, and where it differs from this website, the agreement governs.
Sending the contact form, emailing us, or having the first phone call does not commit you to anything and does not commit us to accepting the search.
What we do, stated exactly
We are a placement agency. We define the role with you, recruit, vet, and present candidates, and support the placement afterwards. The family that hires becomes the household employer.
That is not a technicality, so it is worth spelling out what follows from it:
- We do not employ the caregiver. Not before the placement, not after it
- We do not pay the caregiver. You pay your nanny directly. Our fee is separate and goes only to us
- We do not set the caregiver's rate. You and your nanny agree that between you. We will tell you what the local market looks like if you ask
- We do not supervise or direct the caregiver's work. Once the placement begins, the working relationship is yours
- We do not write your employment agreement. We provide an attorney-drafted work agreement template. You and your nanny complete your own terms and sign with each other
Payroll, tax withholding, and employer filings are the household employer's responsibility. We can point you to services that handle it, and we do not do it for you.
What we can and cannot promise
What we promise is that the vetting described on this site is actually done, that nobody is presented to you who has not been vetted, and that we tell you the truth about what we found.
What we cannot promise is any person's future conduct. No agency can honestly promise that, and one that does is selling you something it does not have. Screening reduces risk. It does not remove it.
We also cannot guarantee that a search will produce a hire. Candidate availability varies by market and by role, and some searches do not end in a placement.
Hiring is your decision. We present, verify, and advise. You choose.
Fees, and the replacement guarantee
The fees shown on the pricing page are current as of the date at the top of this page and may change. The fees that apply to your search are the ones written into your signed engagement agreement, and they do not change once that is signed.
The $350 application fee is not refundable. It pays for the needs assessment and the opening stage of the search, and that work is done whether or not the search ends in a hire. The $3,500 placement fee is due only if you hire someone we present.
An engagement does not expire on a set date. Searches take the time they take, and we would rather keep looking than close a file to meet a deadline. How a search is closed, by either of us, is set out in your engagement agreement.
The replacement guarantee covers our work, not any person's behaviour. If a nanny we placed resigns, or is dismissed for cause, within 90 days of their first day, we conduct a replacement search at no additional placement fee.
It applies once. After one replacement search, the guarantee is spent.
It does not apply where your needs change after hiring, where the terms you and the nanny agreed are changed after hiring, or where fees are unpaid. It does not cover a placement that ends for other reasons, including a match that simply turns out not to fit. We will always talk with you about those. They sit outside the guarantee.
Using the site
Please use this website for its intended purpose. Do not use the contact form to send unsolicited commercial messages, do not attempt to interfere with the site or its security, and do not scrape or republish its contents.
The text, photographs, logo, and design of this site belong to Briar & Root LLC. The name, the emblem, and the monogram are ours and are not to be used without written permission. Quoting a sentence with a link back is fine.
Information you send us through this site is covered by our privacy policy. Please do not send sensitive personal information, such as social security numbers or financial account details, through the contact form.
Accuracy, availability, and other websites
We keep this site accurate and current, and we will correct errors when we find them. Even so, the site is provided as it is, without warranty, and we cannot promise it will always be available or entirely free of mistakes.
Where we link to another organisation, such as a payroll service or a screening provider, we do so because we think it is useful. We do not control those sites and we are not responsible for their content or their practices.
Nothing on this site is legal, tax, or employment advice. Household employment rules are real and they are specific to your situation. Please take proper advice on them.
Governing law, and changes to these terms
These terms are governed by the laws of the State of Indiana, without regard to its conflict of law rules. Any dispute arising from this website is subject to the courts of Kosciusko County, Indiana.
We may update these terms. The date at the top of the page shows when they last changed, and the version in force is the one published here.
